Agreement

These Terms of Service (“Terms”) govern your access to and use of Social Fetch’s websites, APIs, dashboards, documentation, and related services (collectively, the “Services”). By using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

The Services

Social Fetch provides programmatic access to publicly available social and web platform data through a unified API. We may modify, suspend, or discontinue features with reasonable notice when practicable. We do not guarantee uninterrupted availability and may perform maintenance that temporarily affects access.

Accounts and API keys

You may need an account and API credentials to use the Services. You are responsible for safeguarding your keys and for all activity under your account. Notify us promptly at support@socialfetch.dev if you suspect unauthorized use.

Acceptable use

You agree not to:

  • Use the Services in violation of applicable law or third-party terms.
  • Attempt to access non-public data, bypass rate limits or technical controls, or probe our systems in ways that could harm availability or security.
  • Resell or redistribute the Services in ways that misrepresent their source, or use them to build a substantially similar competing API without our written consent.
  • Use outputs to harass, discriminate against, or harm individuals or groups.

You are responsible for your own product, including how you use retrieved data under platform policies, contracts with your customers, and applicable privacy and marketing laws.

Fees and billing

Paid use is typically metered via credits or similar units described at checkout or in your account. Fees are charged through our payment processor (for example, Stripe) according to the prices shown when you purchase. Taxes may apply where required. Except where mandated by law, payments are non-refundable once credits or entitlements are delivered.

Intellectual property

We retain all rights in the Services, our software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes or to power your applications for your end users, in each case as intended. Data returned by the API may be subject to third-party rights; we do not grant you ownership of underlying platform content.

Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PUBLIC DATA CHANGES FREQUENTLY; WE DO NOT WARRANT ACCURACY, COMPLETENESS, OR AVAILABILITY OF ANY PARTICULAR RECORD.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL FETCH AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF GREATER, ONE HUNDRED U.S. DOLLARS). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You will defend and indemnify Social Fetch against claims, damages, and costs (including reasonable attorneys’ fees) arising from your use of the Services, your products, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

Suspension and termination

We may suspend or terminate access for breach of these Terms, risk to the Services or others, or legal requirement. You may stop using the Services at any time. Provisions that by their nature should survive (including limitations of liability, indemnity, and intellectual property) will survive termination.

Changes

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Services.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law principles. Courts in Delaware (or federal courts located there, where applicable) have exclusive jurisdiction for disputes, except that you or we may seek injunctive relief in any court of competent jurisdiction. Mandatory consumer protections in your country may still apply where they cannot be waived.
